Overview

Salem is located in Oregon. Drone operations are governed by federal FAA regulations (14 CFR Part 107) and may be subject to state and local ordinances.

State Regulations & Statutes

Oregon has enacted a comprehensive UAS statute at ORS § 837.300 through § 837.380 (Oregon UAS Act). The Act prohibits flying drones over private property below 400 feet with the intent to conduct surveillance, bars law enforcement from using drones without a warrant except in specific emergency circumstances, and establishes restrictions on commercial drone operations. ORS § 837.320 provides a cause of action for individuals whose privacy is violated by drone surveillance. Oregon does not fully preempt local governments, allowing cities and counties to impose restrictions on public property. Salem, as the state capital, has added sensitivities around the Oregon State Capitol and government facilities. LAANC authorization is required for flights near McNary Field (Salem Municipal Airport).

Applicable Statutes & Penal Codes

  • ORS § 837.320: Prohibits drone surveillance over private property below 400 ft without consent
  • ORS § 837.340: Restricts law enforcement drone use — warrant required except in emergencies
  • ORS § 837.360: Prohibits interfering with manned aircraft using a drone
  • KSLE (Salem Municipal/McNary Field) Class D airspace — LAANC required within approximately 4 miles
  • Oregon State Capitol and state government campus: Potential TFRs and security considerations
  • Oregon Department of Forestry fire season: Aerial firefighting TFRs common June–October over Willamette Valley
  • FAA Part 107 Remote Pilot Certificate required for all commercial UAS operations
  • FAA drone registration required for all UAS over 0.55 lbs

Permits & Registration

Commercial operations require FAA Part 107 Remote Pilot Certificate. LAANC authorization is required for flights near KSLE — use FAA DroneZone or Aloft app. Oregon State Parks and Recreation Department manages Silver Falls State Park (the 'Crown Jewel' of Oregon state parks, approximately 25 miles east) and requires drone permits for all operations. Salem city parks require advance permits from the City of Salem Parks and Recreation Division. Oregon State Capitol grounds are state property — coordinate with Oregon State Police and Capitol security for any flights. During fire season (June–October), monitor for TFRs related to aerial firefighting operations throughout the Willamette Valley.

Local Ordinances

Salem does not have a standalone drone ordinance but enforces restrictions through the Oregon UAS Act, city park rules, and FAA airspace requirements. McNary Field (Salem Municipal Airport, KSLE) is located approximately 4 miles south of downtown, with Class D airspace covering much of southern Salem. The Oregon State Capitol complex in downtown Salem is a sensitive government facility. The Willamette River corridor through Salem offers scenic drone photography opportunities but requires attention to park permit requirements and the KSLE Class D boundary. Summer fire season generates frequent aerial firefighting TFRs throughout the region.

Local Restrictions & Rules

  • KSLE Class D airspace: LAANC required within approximately 4 miles — affects southern Salem and Willamette Valley approaches
  • Oregon State Capitol grounds: State security zone — coordinate with Oregon State Police for any flights
  • Salem city parks: Advance permit required from City of Salem Parks and Recreation Division
  • Willamette River corridor (Bush's Pasture Park, etc.): City permit required; check KSLE Class D boundary
  • Chemeketa Community College campus: College property — authorization from campus security required
  • Willamette University campus: Private university — facilities management authorization required
  • Fire season TFRs (June–October): Monitor NOTAMs daily — aerial firefighting TFRs frequently activate without advance notice
  • Silver Falls State Park: OPRD permit required; extremely popular — obtain permits well in advance

Local Flying Guide

Always verify conditions with local authorities and property owners before flight.

Potential Safe Flying Locations

  • Rural Marion County farmland east of Salem — outside Class D airspace; landowner permission required
  • Polk County agricultural areas across the Willamette River west — verify KSLE Class D boundary; farm permission needed
  • Ankeny National Wildlife Refuge (with permit) — USFWS managed; drone permit required but less congested airspace
  • Silverton area farmland (approximately 15 miles east) — Silver Creek Valley; check B4UFLY; outside Class D
  • Dayton / McMinnville area farmland northwest — confirm outside KSLE Class D; check McMinnville airport (KMMV)

Areas to Avoid

  • KSLE Class D airspace — affects southern Salem; LAANC required
  • Oregon State Capitol complex — state security; coordinate before any flights
  • Silver Falls State Park — OPRD permit required for all drone operations
  • All Salem city parks — permit required from Parks and Recreation Division
  • Aerial firefighting TFR zones (June–October) — monitor NOTAMs continuously during fire season
  • Willamette River within KSLE Class D boundary — verify authorization before waterway flights
  • Salem Municipal Airport perimeter — no unauthorized approach within Class D without LAANC

Weather Considerations

Salem sits in the Willamette Valley, sheltered by the Coast Range to the west and the Cascades to the east. This position creates a moderate marine climate with mild, wet winters and warm, dry summers. The valley can trap cold air in winter inversions, producing fog (the 'Valley Fog') that can persist for days from December through February. Marine fog from the Pacific coast occasionally reaches the valley in summer mornings. Fire season from June through October creates smoke hazards — smoke can reduce visibility to under a mile across the valley. The Cascades to the east create orographic lift and afternoon convective potential in summer. Check NWS Portland (weather.gov/pqr) for Willamette Valley forecasts.

Seasonal Tips

BEST: June–September (dry season, minimal fog, excellent visibility when smoke-free; July and August are optimal). AVOID: December–February (persistent valley fog — can last 10+ days straight, cold and damp, battery performance reduced in cold), peak fire season in August–September (smoke from Cascade fires often settles in the valley, reducing visibility to near zero). Spring (March–May) is beautiful but wet. Fall (October–November) excellent if fog and early smoke clear. Always check fire weather and active TFRs in summer and fall.

  • ✓ Oregon state regulations
  • ✓ Salem local ordinances
  • ✓ B4UFLY airspace check
  • ✓ LAANC authorization if in controlled airspace
  • ✓ Property owner permission
  • ✓ Weather safety
