Overview

Santa Fe is located in New Mexico. Drone operations are governed by federal FAA regulations (14 CFR Part 107) and may be subject to state and local ordinances.

State Regulations & Statutes

New Mexico has no single comprehensive state drone statute and relies primarily on FAA federal regulations (14 CFR Parts 101 and 107) to govern UAS operations. Privacy protections come from NMSA § 30-12-1 (invasion of privacy), which can apply to drone surveillance of individuals without consent. Criminal trespass under NMSA § 30-14-1 applies to drones operated over private property without permission. The New Mexico Energy, Minerals and Natural Resources Department (EMNRD) prohibits drone operations in all New Mexico State Parks without a special use permit. Santa Fe sits adjacent to the Santa Fe National Forest, where USFS regulations apply, and is close to Bandelier National Monument, which is subject to NPS 36 CFR § 1.5 restrictions prohibiting UAS without a Special Use Permit. Santa Fe Regional Airport (KSAF) creates Class D airspace requiring LAANC authorization for nearby operations.

Applicable Statutes & Penal Codes

  • NMSA § 30-12-1 — Invasion of privacy: drone surveillance of persons without consent may constitute criminal invasion of privacy
  • NMSA § 30-14-1 — Criminal trespass: drone flights over private property without permission may constitute trespass
  • EMNRD — NM State Parks: drones prohibited without special use permit (includes Hyde Memorial State Park near Santa Fe)
  • Bandelier National Monument — NPS 36 CFR § 1.5: drone operations prohibited without NPS Special Use Permit; rarely granted recreationally
  • Santa Fe National Forest — USFS: commercial use permit required; recreational flyers follow 14 CFR Part 101
  • 14 CFR § 91.129 — LAANC or ATC authorization required near Santa Fe Regional Airport (KSAF) Class D airspace
  • 14 CFR Part 107 — Remote Pilot Certificate required for commercial drone operations

Local Ordinances

The City of Santa Fe has enacted filming and commercial activity permit requirements that apply to drone operations on City-owned property, including parks, plazas, and public rights-of-way. The historic Santa Fe Plaza area is subject to special event and filming permit requirements. The City's Parks and Recreation Division manages several parks where drone takeoff and landing requires advance authorization. The proximity of KSAF creates airspace concerns for the north side of the city. Pueblo lands surrounding Santa Fe — including San Ildefonso, Pojoaque, and Tesuque Pueblos — are sovereign tribal territories where drone flights require explicit tribal permission.

Local Restrictions & Rules

  • City of Santa Fe filming permit required for commercial drone photography on City property — includes Plaza, City parks, and public rights-of-way
  • Hyde Memorial State Park — NM State Parks/EMNRD: drone permit required
  • Bandelier National Monument (~40 mi northwest) — NPS: drones prohibited without Special Use Permit
  • Pecos National Historical Park (~25 mi east) — NPS: drones prohibited without Special Use Permit

  • Galisteo Basin (~20 mi south — outside airport airspace, mostly private/state land; obtain permission from landowners)
  • El Rancho de las Golondrinas area (~15 mi south — open agricultural land outside Class D; private property permission required)

Areas to Avoid

  • Santa Fe Regional Airport (KSAF) Class D — 4.4 nm radius north of city; LAANC authorization required

  • Hyde Memorial State Park — NM State Parks: permit required
  • Santa Fe National Forest — USFS commercial permit required
  • Pecos National Historical Park — NPS: drones prohibited without Special Use Permit
  • All Pueblo tribal lands — sovereign territory: explicit tribal authorization required

Weather Considerations

Santa Fe sits at 7,199 ft elevation — the highest state capital in the US. This altitude significantly reduces drone lift and battery efficiency; expect 15–25% shorter flight times than at sea level. Spring winds are frequently 20–40 mph with occasional gusts to 60 mph. Afternoon monsoon thunderstorms arrive reliably July through mid-September. Winters bring cold temperatures (below 20°F possible) that further reduce battery performance. Check NWS Albuquerque (weather.gov/abq) for Santa Fe-area forecasts.

Seasonal Tips

BEST: May–June (before monsoons) and September–October — mild temperatures, spectacular skies, calm morning winds. AVOID: July–August monsoon afternoons (thunderstorms often develop rapidly after 2 PM). AVOID: January–February for bitterly cold temperatures that drain batteries. Always fly in the morning; by afternoon winds and thermal activity increase significantly at this elevation.

  • ✓ New Mexico state regulations
